Terms and Conditions

  1. AGREEMENT

 

1.1 These terms of use, constitutes a legal and binding contract ("Agreement") between you and The Traveling Crew (“Company”), a company licensed under Traveling Crew Portal (United Arab Emirates) with DED License No. 989821 and WCA Travel and Tours (Philippines) having its registered office at U-3B Bldg. 20, Capri Condo, West Service Road KM 21, Cupang, Muntinlupa City, Philippines, 1781, any other service that may be provided by The Traveling Crew from time to time (collectively referred to as the ("Services"). You hereby agree and understand that this Agreement is a binding contract between The Traveling Crew and the you (“Client”) hereby agree to be bound by the terms contained in this Agreement. The terms contained in this Agreement shall be accepted without any modification. The use of the Services would constitute acceptance of the terms of this Agreement.

 

1.2 You must be 18 (eighteen) years of age or older to avail the Company’s Services in any manner.

 

1.3 This Agreement is published in compliance with and is governed by the provisions of Philippine law.

 

2. PASSPORTS & VISAS

 

2.1 Your travel to foreign countries may be subject to the visa and other immigration related requirements as may be prescribed by appropriate authorities from time to time. You hereby understand and agree that you shall have to procure the applicable visa and comply with all applicable immigration requirements by yourself and The Traveling Crew shall not be under any obligation to inform you or assist you with obtaining the appropriate visa (including transit-visas, on-entry visas, etc.) or with the concerned immigration requirements not unless such visa services are availed.

 

2.2 The Traveling Crew shall not be responsible for any issues, including                inability to travel, arising due to your failure to obtain the appropriate visa or clear any immigration obligations that you may have. Your transaction with The Traveling Crew does not guarantee entrance to the country of destination. The Client understands that The Traveling Crew accepts no responsibility for determining passenger's eligibility to enter or transit through any specific country.

  • Visa Services

    • Visa Approval is up to immigration only.

    • Visa process will begin only once all the required documents are complete.

    • We recommend that all passengers should enter the country within 14 days of the issuance of the visa.

    • All visa applications and charges depend on the nationality of the said passenger.

    • In case of any rejection, The Traveling Crew is not responsible for the application charge.

    • If a person does not leave UAE within the required time as per their visa, then all the fines will be paid by the Client / Sponsor of Applicant.

    • In case of all kind of overstays or absconding of the applicant, all the fines will be paid by Client / Sponsor of application.​

3. PAYMENTS


3.1 All fares quoted by The Traveling Crew are subject to availability and are only  available when payment has been received from the Client.

 

3.2 Payment must be made using the following methods:

  • BPI Bank deposit (Philippines)

  • ENBD Bank Deposit (UAE)

  • ENBD Online/Mobile Banking or MePay

  • Credit/Debit card payments via Paypal (Subject to 3% Paypal Charge)

  • Remittance Centers (Western Union, Moneygram, STC Pay, Al Ansari Exchange, etc.)

3.3 The Traveling Crew shall have the right to charge transaction fees based on certain completed transactions using the Services. These charges/fees may also be altered by The Traveling Crew without any notice. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the Services.

3.4 By booking with The Traveling Crew, you authorize its agents to transact with your bank or other payment gateways on your behalf to obtain the necessary information required to process payment, confirm payment, resolve inquiries and billing disputes, and/or as otherwise required to manage the booking.

3.5 You hereby understand and agree that your reservation/booking is contingent upon The Traveling Crew receiving the applicable fees/consideration/fares in its account and unless such monies have been credited into The Traveling Crew’s account, it shall be under no obligation to issue you with the relevant tickets,   reservation confirmation, passenger name record (PNR) or such other confirmations in connection with the Services.

3.6 In the event a booking or reservation does not get confirmed for any reason, The Traveling Crew is under no obligation to make another booking to compensate or replace the earlier booking. All subsequent bookings shall be treated as new transactions without any reference to the earlier transactions. All refunds shall take place as per the normal banking payment cycle.

3.7 In order to process payments, The Traveling Crew may require for you to submit the proof of payment and have it verified within 48 hours.

4. CANCELLATION AND REFUND 

​

4.1 All of our airline tickets, hotels, vacation packages and service fees are as per the terms and conditions of the Provider (Airlines, Hotels, etc) all the bookings to be made as per the Providers and The Traveling Crew’s Terms and Conditions. All cancellations must be done by email only. We can accept refund requests only if the following conditions have been met:

  • You have applied for a cancellation and refund with us and if the fare rules provide for cancellation and refunds;

  • You are not a "no show" (most "no show" bookings are in-eligible for any waiver from Providers for refund processing); and

  • We are able to secure waivers from Providers to process the requested cancellation and refund.

  • The details concerning ticket refunds are set out in the specific terms that apply to it. If these permit a refund, The Traveling Crew reserves the right to charge a processing fee of up to 20% of the cost of the ticket if The Traveling Crew is involved in the administration of the refund.  The Provider may charge a processing fee.

  • The processing fees made in respect of exchanges and cancellations, if The Traveling Crew is involved in their administration, are in addition to any charges that may be made by the Provider concerned.

  • Refunds on partially used tickets are not available.

  • All refunds will be made by any method by which The Traveling Crew deems, if The Traveling Crew is involved in the administration.

  • Cancellation or refund of the visas that have been utilized by the clients are non-refundable and there is no refund applicable in cases of visa rejections from the Dubai Immigration. In case of cancellation of the visa services by the client himself, charges will be applied, and they will have to be borne by the client solely.



5. FARE CHANGES

 

5.1 All bookings are not guaranteed until ticketed. Airfare is only guaranteed once the purchase has been completed and the tickets have been issued. Fare change can occur even between the time of selection of flight and subsequent issuance. Therefore, the fare/tariff is not guaranteed till the issuance. We will notify you of any fare changes and we do not assume any responsibility, financially or otherwise for any such fare changes made by the Provider. We will notify you of the new fare and at that point you may either cancel or still purchase the product or service at the new cost. 


 

6. BOOKINGS AND RESERVATIONS

 

6.1 When a ticket, tour or other service (hereinafter referred to as ‘ticket’) is reserved, The Traveling Crew via Via PH sends an email confirming the booking, with a booking reference number. Ticket and Hotel Bookings may also be booked using different vendors and/or company and an email will be sent to the client's respective email from askthetravelingcrew@gmail.com.

 

6.2 A booking fee may be charged.

 

6.3 Examine tickets carefully upon receipt.  Both the Provider and The Traveling Crew accept no liability for ticket errors resulting from incorrect information provided by you.

 

6.4 If there is any inaccuracy, the Provider must be notified within 24 hours of receipt of your tickets.

 

6.5 The Provider aims to ensure that all tickets booked through The Traveling Crew are issued correctly and efficiently but in the event of any error or delay occurring in connection with the booking or the issue of tickets, the maximum liability to the Client or Customer will be to refund the price of the ticket, notwithstanding these terms and conditions.

 

6.6 Names on travel documents must match exactly those shown on passports, where applicable.

 

6.7 If an e-ticket has been provided by The Traveling Crew, it must be taken when traveling as it may be required on demand.  Customers should also have a valid form of identification during travel.

 

7. FORCE MAJEURE

 

7.1 The Traveling Crew will not be liable for any delay, poor performance or failure in  performance caused by matters beyond The Traveling Crew’s reasonable control.

8. RESPONSIBILITIES OF THE CLIENT

​

8.1 You are responsible for arranging your own travel insurance, unless availed through the Company. An appropriate policy can be incorporated into your package. Details of all insurance policies held by each member of your party must be provided on the booking form. No booking forms can be accepted without sufficient proof that personal policies have been arranged. Please ensure that your insurance cover applies to the specific activities you are booking, and which are confirmed on the Confirmation Invoice.

 

8.2 Each member of the party must have a valid passport, visas and all necessary documentation for the countries they are touring/visiting. The Company accept no responsibility for any delay or expense should your documents not be in order.

8.3 You are responsible for checking-in for flights at the correct time and for presenting yourself to take up all pre-booked components of your holiday/travel. The Company cannot accept responsibility for clients missing flights as a result of late check-ins and no credit or refunds will be given if you fail to take up any component of your holiday/travel. No credit of refunds will be given for lost, mislaid or destroyed travel documents.

 

8.4 By booking with the Company you undertake to behave in an orderly manner and not to disrupt the enjoyment of others with you nor to do anything to bring the reputation of the Company into disrepute. If you breach this clause your package will be terminated with immediate effect and the Company will have no further contractual obligation to you. The Company will be entitled to recover from the offending party and/or the person who signed the booking form compensation for any damage caused.

 

8.5 It is the responsibility of the person who signs/accepts the Booking Form to disclose any pre-existing medical conditions that members of their party may have.

 

8.6 All equipment and personal effects shall be all times and in all circumstances at the owner’s risk. The Company cannot accept responsibility for any loss or damage or delay to your luggage or effects unless directly caused by the negligence of one of our representatives.

 

9. HUMAN ERROR

 

9.1 If any of our agents/employees make a mistake in the booking process, we shall make reasonable attempts to rectify these errors at the time of occurrence. The Traveling Crew stands committed to providing compensation up to a maximum of the entire service fees that The Traveling Crew has collected from you for that booking within 12 months provided that you notify us of errors within 24 hours of receiving your itinerary. Beyond this 24-hour period, The Traveling Crew will not be responsible for these errors.

 

10. NOTICES


10.1 All notices and communications shall be in writing, in English and shall deemed given if sent via email with due acknowledgment of The Traveling Crew.

 

11. CHILD’S POLICY

 

11.1 The Traveling Crew does not sell any travel services to children below the age of 18 years of age. All Services shall be availed by the parent/guardian.

12. AMENDMENT FEES

 

12.1 An amendment fee per Booking may be levied for any changes to the confirmed itinerary and or ticket. The Traveling Crew’s amendment fee is charged in addition to any amendment fees which may be charged by the relevant Provider. The Traveling Crew will provide (1) free amendment for travel itinerary and invitation letter. All other amendments will incur a service fee as per current service rate.

13. BALIKBAYAN SERVICES

​

13.1 The Traveling Crew's Balikbayan Services are optional services that can be availed by the returning Filipinos, Tourists traveling to the Philippines and OFW's (Overseas Filipino Workers) who wish to make their own reservation and not avail of the free government quarantine services.

​

13.2 The Traveling Crew shall provide a detailed quotation for client review upon request. 

​

13.3 The Traveling Crew shall provide at least (2) two hotel options for the client to choose from

​

13.4 All charges by hotel partners and airport transfer groups are subject to the respective company's terms and conditions. Rebooking, Cancellation and Refund terms and conditions by partner establishments shall be followed by The Traveling Crew.

​

13.5 Form amendments shall be made by The Traveling Crew free of charge.

​

13.6 Should there be a cancellation of flight or permanent cancellation of travel plans, refund will be given subject to partner company policy. The Traveling Crew's Balikbayan Services charge is strictly NON-REFUNDABLE.
